Terms of Service

These Terms of Service ("Terms") govern your use of watchmancounseling.com (the "Site"), operated by Hector L. Figueroa, LMSW, doing business as Watchman Counseling ("we," "us," "our"). By using the Site or scheduling a consultation, you agree to these Terms.

The Site is informational. It is not therapy. Visiting this website, reading its content, or messaging through its chatbot does not create a therapist-client relationship. A therapeutic relationship is established only after an intake appointment is completed and informed consent is signed.

1. No emergency services

If you are experiencing a mental health emergency, do not use this Site. Call 988 (Suicide & Crisis Lifeline) or 911, or text HOME to 741741. Watchman Counseling does not monitor messages or calls 24/7 and cannot respond to crises in real time.

2. Eligibility & jurisdiction

Hector L. Figueroa is licensed in New York State only. Therapy services are provided via telehealth to clients physically located in New York at the time of session. The Site is not intended for and may not be used by individuals seeking therapy in jurisdictions where the provider is not licensed.

All content on this Site — including text, photographs, logo, and design — is owned by Watchman Counseling or licensed for our use, and is protected by copyright and trademark law. You may not copy or reuse content for commercial purposes without written permission.

5. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties to the fullest extent permitted by law.

6. Limitation of liability

To the fullest extent permitted by law, Watchman Counseling and Hector L. Figueroa shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site. Liability for direct damages is limited to the amount you have paid (if any) for services in the twelve months preceding the claim.

This limitation does not apply to liability that cannot be limited under applicable law, including liability for professional negligence governed by New York licensing rules.

The Site links to or integrates with third-party services (Cal.com, Google, Hostinger, Voiceflow, HighLevel). We are not responsible for the content, availability, or privacy practices of those services.

You agree to indemnify and hold harmless Watchman Counseling from any claims, losses, or damages arising out of your violation of these Terms or misuse of the Site.

9. Governing law & dispute resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall first be addressed by good-faith informal discussion. If unresolved within 30 days, the parties agree to attempt mediation in Westchester County, New York before pursuing litigation. Nothing in this section limits your rights under the No Surprises Act or other consumer-protection statutes.

10. Changes to these Terms

We may modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Continued use of the Site after changes constitutes acceptance.

11. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
